If you have no other choice but to mention your boss as a reference and you believe that your boss will write a negative reference, so as to unfairly harm your future job prospects, you may be able to sue for 'negligent misstatement.' You will need to show that the information your former employer is stating in the reference, is misleading, and that the former employer was negligent in providing a positive reference.
Moreover, if you think there was discriminatory retaliation or defamation of character, there is more reason to sue.
Obviously, just because you have a bad reference from a bullying boss, doesn't mean you are incapable of doing better, on a different job.There are reference checking firms who check references and can report back to you. Always provide alternative references that are positive and strong when describing your skills.
